Transmission won't stay or go into gear

Dodge Grand Caravan 2000 4 door SE, 3.3 flexfuel 285000 miles
Heading home after picking up the wife from her work one night and the van just kicks its self out of gear. I managed to get it back into gear for another block and that was it. Had it towed home. Two weeks later I was checking it out, started it up with a loud whining noise but it jumped into gear backed it up and pulled it forward and down it went again. My cheap OBD2 scanner read out that the ECM and the TCM was not communicating with each other. It has tranny fluid in it. I'm not sure if it could be the transmission it self or one of if not both of the cv axles or maybe the TCM.
